House Bill 4, the Texas Data Privacy and Security Act (TDPSA), Goes Into Effect January 1
What it does The TDPSA regulates how businesses collect, use, store, process, and sell consumer data. It also gives consumers rights over their data, including:
The right to know if their data is being processed
The right to access their data
The right to correct inaccuracies in their data
The right to delete their data
The right to receive a portable copy of their data
Who it applies to The TDPSA applies to businesses that conduct business in Texas or produce products or services for Texas residents. It does not apply to state agencies or political subdivisions.
When it takes effect Most of the TDPSA took effect on July 1, 2024, but Section 541.055(e) will take effect on January 1, 2025.
Who enforces it The Texas Attorney General’s Consumer Protection department enforces the TDPSA. You can file a complaint about a business’s privacy practices with the Office of the Attorney General.
